TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of PinClick (the "Service"), a software-as-a-service platform operated by PinClick ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PinClick is a marketing-automation platform that helps you generate lead-magnet pages, email sequences, and social media pin content, and schedule and track them. The Service is provided on a subscription basis. We may update, improve, or modify features over time.

2. Accounts & eligibility

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for safeguarding your login and all activity under your account.
• You must provide accurate information and keep it up to date.

3. Bring-your-own API keys

PinClick operates on a "bring-your-own-key" model. You connect your own third-party accounts and API keys (for example: an LLM provider, an email platform such as Kit, and a Pinterest developer app). You are solely responsible for those third-party accounts, their fees, their terms, and any usage limits. We store your keys encrypted at rest and use them only to operate the Service on your behalf.

4. Acceptable use

You agree not to use the Service to:

• Violate any law, third-party platform terms (including ClickBank, Pinterest, or your email provider), or intellectual-property rights.
• Generate spam, deceptive, or misleading content, or send email to people who have not opted in.
• Promote illegal products, or content that is hateful, harassing, or sexually exploitative.
• Reverse-engineer, resell, or abuse the Service or its infrastructure.

You are responsible for the content you generate and publish through the Service and for complying with the rules of any platform you connect.

5. Subscriptions, billing & Merchant of Record

Paid plans are billed in advance on a recurring monthly or annual basis. Our payments, invoicing, and applicable sales taxes/VAT are handled by our reseller and Merchant of Record, Paddle.com. Your purchase is therefore also subject to Paddle's buyer terms. Subscriptions renew automatically until cancelled. You can cancel at any time from your account or by contacting us; cancellation stops future renewals.

6. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

7. Intellectual property

We own the Service, its software, and branding. You own the marketing content you generate through the Service. You grant us a limited licence to process your content and credentials solely to provide the Service.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. PinClick is a productivity tool; we do not guarantee any sales, commissions, traffic, or income. Outcomes depend on your inputs, your connected accounts, and third-party platforms outside our control.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising from the Service is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages, or for losses caused by third-party services you connect.

10. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate accounts that breach these Terms. Upon termination your right to use the Service ends.

11. Changes

We may update these Terms; material changes will be posted on this page with a new "last updated" date. Continued use after changes constitutes acceptance.
